2. Applicability

These Terms apply to all offers, orders, agreements, and deliveries made through our website. By placing an order, the customer agrees to be bound by these Terms. Any deviations from these Terms are only valid if expressly agreed upon in writing.

3. Products & Intended Use

FITFRAME products are designed for fitness and training purposes and must be used in accordance with their intended purpose, specifications, installation manuals, and safety instructions.

The products may be used for private and commercial purposes. Commercial or professional use includes, but is not limited to, use in gyms, fitness studios, hotels, rental properties, or other business environments. Such use may involve increased loads, frequency, and risk, and is the sole responsibility of the customer.

The customer is responsible for ensuring that the product is suitable for their intended use and environment.

4. Orders & Contract Formation

All orders placed through the website are subject to acceptance and availability.
A binding agreement is formed once the customer places an order and receives an order confirmation by email. For pre-orders, payment may be deferred and automatically collected prior to shipment.

We reserve the right to refuse or cancel an order at any time if required, including in cases of incorrect pricing, availability issues, or suspected misuse.

5. Pre-Orders

Some products are offered as pre-orders. By placing a pre-order, the customer acknowledges that delivery will take place at a later date as indicated on the product page or communicated separately.

Delivery dates for pre-orders are estimates and may be subject to change due to production, logistics, or other unforeseen circumstances. Delays do not entitle the customer to compensation beyond statutory rights.

6. Prices & Payments

All prices displayed on the website are stated in the applicable currency and include VAT where required by law, unless stated otherwise.

Available payment methods are displayed during checkout and may include Shop Pay, credit cards, digital wallets, local payment methods, and buy-now-pay-later services such as Klarna. We reserve the right to change or limit payment methods at any time.

7. Delivery & Risk Transfer

Products are delivered to the address provided by the customer during checkout. The risk of loss or damage to the product transfers to the customer upon delivery.

Any visible damage or delivery issues must be reported in accordance with our Return & Refund Policy.

8. Right of Withdrawal & Returns

Consumers have a statutory right of withdrawal in accordance with applicable EU consumer protection laws. Conditions, exclusions, and procedures for returns and refunds are described in our Return & Refund Policy, which forms an integral part of these Terms.

9. Warranty & Conformity

Products are covered by statutory consumer guarantees and an additional two (2) year commercial warranty as described in our Return & Refund Policy.

The warranty does not cover damage resulting from improper installation, installation on unsuitable wall structures, misuse, overloading, lack of maintenance, modifications, or use outside the product’s intended purpose or specifications.

10. Installation & Safety

Wall-mounted fitness equipment requires correct installation on suitable load-bearing walls. Customers are solely responsible for verifying wall suitability, structural integrity, and correct installation in accordance with the provided installation manuals and safety instructions.

FITFRAME installation guides provide general guidance and do not replace professional assessment. Customers are encouraged to consult a qualified professional installer if there is any doubt.

11. Liability

To the maximum extent permitted by applicable law, FITFRAME shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profit, loss of revenue, business interruption, or loss of use.

To the extent permitted by law, FITFRAME total liability arising out of or in connection with any order or product shall be limited to the total amount paid by the customer for the product giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded or limited under applicable law.

12. Intellectual Property

All content on the website, including but not limited to text, images, manuals, guides, designs, and trademarks, is the property of PhilGoods or its licensors.

Any copying, reproduction, distribution, or use of this content for commercial purposes without prior written consent is strictly prohibited.

13. Force Majeure

FITFRAME shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to production delays, supply chain disruptions, transportation issues, or governmental measures.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising out of or in connection with these Terms shall be submitted to the competent courts of the Netherlands.
